A voluntary, confidential, non-binding alternative dispute resolution procedure, the mediation process focuses on meetings and utilizes an uninterested third party to facilitate discussions between the parties, seeking a global or partial resolution or best available alternatives. The mediation process allows the parties to provide their own commentary at its inception in a joint session, then separates the parties for candid, private discussions with the neutral, seeking offers and responses to settle ongoing litigation.


Often a contractual obligation, the arbitration process is a binding alternative dispute resolution procedure in which the parties designate a neutral third party to conduct an evidentiary hearing with testimony and evidence. The third party reviews the evidence submitted and provides an evaluative determination, resolving the issues submitted by the parties.
